for the provision of organizational and coordination servicesrelated to participation in a yacht flotilla in the Republic of Croatia

1. General Provisions
1.1. This Public Offer (hereinafter — the “Offer”) is an official proposal by the Individual Entrepreneur:

(hereinafter — the “Organizer”)
to enter into an agreement for the provision of organizational and coordination services with any legally capable individual (hereinafter — the “Participant”).
1.2. This document constitutes a public agreement within the meaning of Articles 633, 641, and 642 of the Civil Code of Ukraine.
1.3. Full and unconditional acceptance of this Offer shall be the payment of the organizational fee by the Participant.
1.4. Acceptance of this Offer confirms that the Participant has fully read the terms, understands their content, and voluntarily agrees to them.
2. Subject of the Agreement
2.1. The Organizer provides the Participant with organizational and coordination services related to participation in a yacht flotilla (Sailing Flotilla / Yacht Week) conducted in the Republic of Croatia on dates determined by the Organizer.
2.2. Organizational services include:
• development of the event concept; • creation of the flotilla route; • coordination of participants; • organization of group activities; • informational support;
coordination of interaction between participants and partners.
2.3. The Organizer is not a tour operator, travel agent, carrier, charter company, or yacht owner.
2.4. Services directly related to transportation, accommodation, yacht charter, insurance, port fees, or catering are not part of this agreement.
3. Status of Third Parties
3.1. Yachts, crews, captains, charter companies, marinas, insurance companies, and other contractors are independent entities.
3.2. The Organizer is not responsible for their activities, the technical condition of yachts, actions of crews, or decisions of port authorities.
4. Cost and Payment Terms
4.1. The payment made by the Participant constitutes an organizational fee for the services provided under this agreement.
4.2. The amount (pricing level) of the organizational fee is specified on the Organizer’s website or in a personal offer sent to the Participant.
4.3. Payment shall be made via bank transfer to the following account:

4.4. The Organizer is not a VAT payer.
5. Rights and Obligations of the Parties
5.1. The Organizer undertakes to:
• properly organize the event; • provide informational support; • coordinate participants.
5.2. The Participant undertakes to:
• independently arrange insurance; • comply with safety rules; • follow the captain’s instructions;
bear personal responsibility for their health condition.
6. Risks and Limitation of Liability
6.1. The Participant acknowledges that participation in a maritime event involves inherent natural risks.
6.2. Participation is at the Participant’s own risk.
6.3. The Organizer is not responsible for:
•weather conditions;•route changes;•actions of the crew;•flight delays;•decisions of border or port authorities;•loss or damage of personal belongings.
6.4. The Organizer’s maximum liability shall be limited to the amount of the organizational fee paid.
6.5. The Organizer does not guarantee completion of a specific route, visiting particular locations, or maintaining the original schedule in cases of weather changes, captain decisions, port authority regulations, navigation restrictions, or other safety-related circumstances.
In the event of route changes, the Organizer shall provide an alternative program equivalent in concept and content, to the extent possible and subject to safety requirements.
7. Cancellation and Refund Policy
7.1. In case of cancellation by the Participant:
more than 90 days before the event — 100% refund;
•60–90 days — 50% refund;•30–60 days — 30% refund;•less than 30 days — no refund.
7.2. The Organizer reserves the right to retain actually incurred expenses.
7.3. In case of event cancellation by the Organizer, participation may be rescheduled to alternative dates or funds may be refunded, including partial refunds, taking into account actual expenses incurred and obligations to third parties.
8. Force Majeure
The Parties shall be released from liability in cases of war, state of emergency, natural disasters, or travel restrictions.
9. Personal Data Processing
The Participant consents to the processing of personal data for the purpose of organizing the event.
10. Final Provisions
10.1. The agreement is concluded by acceptance (payment).
10.2. The Organizer reserves the right to amend this Offer by publishing a new version.
10.3. Disputes shall be resolved in accordance with the laws of Ukraine.
